Agreement to Terms

Welcome to Pupty. These Terms of Service ("Terms") govern your access to and use of the Pupty mobile application ("App"), operated by Pupty ("we," "us," or "our"). By downloading, installing, or using our App, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use the App. We reserve the right to modify these Terms at any time. Your continued use of the App after any changes constitutes acceptance of the new Terms.

Description of Service

Pupty is an AI-powered puppy potty training application that helps users track their puppy's activities and receive predictions for optimal potty times. The App provides:

  • Activity logging for potty, food, and water events
  • AI-powered predictions for potty timing
  • Push notifications and reminders
  • Progress tracking and statistics
  • Achievement and streak tracking

Eligibility

You must be at least 13 years old to use the App. If you are under 18 years old, you must have your parent or guardian's permission to use the App. By using the App, you represent and warrant that you meet these eligibility requirements.

Account Registration

To access certain features of the App, you may need to create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your account credentials secure and confidential
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate your account if any information provided is inaccurate, false, or violates these Terms.

Subscriptions and Payments

Free and Premium Features

Pupty offers both free features and premium subscription options. Free features include basic activity logging and limited predictions. Premium subscriptions ("Pupty Premium") unlock additional features such as:

  • Unlimited AI-powered predictions
  • Advanced analytics and insights
  • Priority customer support
  • Additional customization options

Subscription Terms

Premium subscriptions are billed through Apple's App Store. By subscribing, you agree to:

  • Pay the subscription fee at the beginning of each billing period
  • Automatic renewal of your subscription unless cancelled at least 24 hours before the end of the current period
  • Management of subscriptions through your Apple ID account settings

Free Trials

We may offer free trial periods for premium features. If you do not cancel before the trial ends, you will be automatically charged for the subscription. Unused portions of free trials are forfeited when you subscribe.

Refunds

All subscription payments are processed through the Apple App Store and are subject to Apple's refund policies. To request a refund, please contact Apple Support directly.

Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the App in any way that violates applicable laws or regulations
  • Attempt to gain unauthorized access to the App or its systems
  • Interfere with or disrupt the App or servers connected to the App
  • Use any automated means to access the App without our permission
  • Reverse engineer, decompile, or disassemble any part of the App
  • Remove, alter, or obscure any proprietary notices in the App
  • Use the App to transmit harmful code or malware
  • Impersonate any person or entity or misrepresent your affiliation
  • Collect or harvest any information from other users
  • Use the App for any commercial purpose without our consent

Intellectual Property Rights

The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, graphics, and the design thereof) are owned by Pupty and are protected by copyright, trademark, patent, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms. This license does not include the right to:

  • Modify or copy the App's materials
  • Use the materials for any commercial purpose
  • Transfer the materials to another person or "mirror" the materials on any other server
  • Attempt to reverse engineer any software contained in the App

User Content

You retain ownership of any content you submit to the App, including pet information and activity logs ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, process, and display such content solely for the purpose of providing and improving the App's services.

You are solely responsible for your User Content and represent that you have all necessary rights to submit such content.

AI-Powered Features

The App uses artificial intelligence to provide predictions and recommendations. You acknowledge and agree that:

  • AI predictions are estimates based on patterns and should not be considered medical or professional advice
  • Predictions may not be 100% accurate and should be used as guidance only
  • You remain responsible for your puppy's care and training
  • AI features require data input to function effectively
  • The quality of predictions improves with more data over time

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
  • WARRANTIES OF NON-INFRINGEMENT
  • WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF THE APP'S CONTENT
  • WARRANTIES THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE

We do not warrant that the App will meet your requirements or that any defects will be corrected.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PUPTY, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, use, or goodwill
  • Damages resulting from unauthorized access to or use of our services
  • Damages resulting from any interruption or cessation of transmission to or from the App
  • Damages resulting from errors or omissions in any content

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Indemnification

You agree to defend, indemnify, and hold harmless Pupty and its affiliates, officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from:

  • Your use of and access to the App
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property rights
  • Any content you submit to the App

Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination:

  • Your right to use the App will immediately cease
  • We may delete your account and all associated data
  • Provisions of these Terms that by their nature should survive termination will remain in effect

You may terminate your account at any time by discontinuing use of the App and requesting account deletion by contacting us.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in the United States.

Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to these Terms shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue resolution through binding arbitration or small claims court.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect.

Waiver

The failure of Pupty to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver of any provision of these Terms will be effective only if in writing and signed by Pupty.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pupty regarding the use of the App and supersede all prior agreements and understandings.

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of any material changes by posting the updated Terms in the App or through other communication channels. Your continued use of the App after such modifications constitutes your acceptance of the updated Terms.
